Rest "BAHUT HO GAYA, CHAMCHAGIRI NAHI CHALEYGI" think sanjay what is that employee ? provide more details ! what PA(T)s are doing. is it something against our TREXs benefits ? gladiator salutations to the psa - whats happening at delhi end? there's no update on this site. first of all let me bring to ur notice that u have done a reverse somersault regarding cadre review proposals. earlier u have started trex scale with a grade pay of Rs.5400/- and reverted back to the existing grade pay of 4200/- (in the proposal draft) and after uproar of few vigilant members now the grade pay has been proposed as 4800/-. my question is, rather many of my mates - whats the point in proposing the same grade pay (4200), can we pose the question under whose directions this has been scaled down from the original 5400? if our own brethen undermine the status of trex then what about others? let us all know why such an important is position is downplayed, in most of the stations the trex is the real multi-farious functionary from manning the dutyroom to o.b.coverages to all kinds of production jobs. let us not bother whose pay should start with what grade pay? let us elevate the position of the trex which is real executive in nature. shocking point is our own psa has scaled down the grade pay much to the shock of most of the members and in a hurried manner and in damage control exercise tried to lift the sagged pay to 4800? its shame why trex position is not elevated which is long overdue. will psa guys will enlighten why this sham has taken place and rattled confidence of many a trex? if this is the situation then support to the already fading position of psa will vanish soon when we all thought things were falling in place..............alas! Recruitment done through some special scheme does'nt allow to any type of upgradation financial or promotional. This is the Supremo judgement of SC of India. Whay dont check the judgement orders. It is just more than blunder that PA's are taking benifit something which is against the law. This is a serious matter and our leaders should think about it. Apex Court Constitutional Bench judgment in State of Karnataka vs Uma Devi and Others (SLPCC 9103-9105 of 2001) Sir/ Madam, As a sequel to the recent rectifications of gross irregularities made in the Seniority List of Programme Executives of AIR & Doordarshan which had been perpetuating from 1982 , we would like to draw your attention to some more vital irregularities/ frauds committed by the above said authorities in the past in the matter of appointments and encadrement of erstwhile Staff Artists and some illegally appointed persons, jeopardizing the career prospects of the regular UPSC/SSC recruited Programme Staff. 2. It is stated that while implementing a Cabinet decision of 1982, the Government, through an order no. 25011/26/80-B(A) dated 3rd March, 1982, decided to convert some of the non-performing categories of the contractual employees, i.e., erstwhile staff artists working in AIR & Doordarshan into regular Government servants by screening them in terms of qualifications, experience and record of service etc. This scheme was for those staff artists who were working as such on or before 6.3.1982. It was also decided to convert all the posts held by erstwhile staff artists into civil posts. The cut off date was 6.3.1982, which was also upheld by Hon’ble J&K High Court and Supreme Court in the matter of Mohd. Ashraf Lone. 3. After the promulgation of the above scheme which was in pursuance of a cabinet decision, the Government incorporated the encadrement of certain categories by way of amending the then existing All India Radio Group ‘A’ & ‘B’ Recruitment Rules vide Notification dated 23.10.1984. However, the then authorities grossly violated the provisions of these notified RRs of 1984 and Cabinet decision. These irregularities came to our notice when we received some documents by means of RTI Act. These irregularities/ frauds are summarized as hereunder- i. After the Cabinet decision and Governments’ above said Order of 1982, the posts of staff artists were converted into the civil posts. But, fraudulently, the then authorities appointed their kith and kin and some others even after the cut off date i.e., 6.3.1982 in the name of Science Officer/ Sr.Producer/ Reference Officer/Producer etc. without any posts/vacancies and RRs. Not only this, but these illegally recruited persons were illegally encadred with Group ‘A’ posts of regular programme cadre (ASD), e.g., Smt. Aparna Vaish (illegally appointed as Science Officer on 1.9.1983 , illegally made Govt servant in 1988, and illegally retrospectively made ASD w.e.f. 1.1.1986 and now working as DDG-I/C in Doordarshan), Smt. Deepa Chandra (illegally appointed as Science Officer on 23.9.1984, illegally made Govt servant in 1988, and illegally retrospectively made ASD w.e.f. 1.1.1986 and now working as Sr. Director in Doordarshan), H.K. Pani(illegally appointed as Science Officer on 1.4.1984, illegally made Govt servant in 1988, and illegally retrospectively made ASD w.e.f. 1.1.1986 and now working as DDG-I/C in AIR) and many more. Copy of enclosed order dated 23.5.1988 can prove that how such persons were illegally appointed on contract basis after the cut off date and then in the name of M/o I&B’s above said order dated 3.5.1982, they were illegally converted into the temporary civil posts in 1988. When the information was sought from the Department as to “ what were the factors for fitment of Science Officers in the grade of ASDâ€, the reply was ‘Not Available’ (copy enclosed) and it is reliably learnt that the UPSC is going to further promote these persons to the post of regular DDGs. Similarly, a huge number of persons (in hundreds) like Ms Indira Mathur, K.B.Gopalan, Swapna Mandal, Pradip Mitra, Shailaja Suman , Producers from DDK Thiruvananthapuram, etc… and many others were also likewise first appointed through contract after the cut off date, i.e., 6.3.1982 and thereafter illegally regularised by violating the Cabinet decision for regularization of the then existing staff artists (who were in service as on 6.3.1982) and the notified RRs. The UPSC also failed to discharge their duty by ignoring the Cabinet decision, cut off date on which the erstwhile staff artists should have been in the service and appropriate grade for encadrement as per notified RRs of 1984. ii. As per the notified RRs of 1984, the Producer (Selection Grade), Producer (Grade I) and Science Officer who were holding the above mentioned posts as on 6.3.1982 (and would not retire by 28.2.1982) were to be encadred with Programme Executive (Grade) (copy of RRs enclosed). It is stated that as per these RRs, the post of Programme Executive is the feeder grade for the post of ASD and they (PEX) were required to have 5 years regular service in the grade of PEX/PEX (Grade) for promotion to the post of ASD. But, in gross violation of these notified RRs, these categories of Producer (Selection Grade), Producer (Grade I) and Science Officer were directly encadred with the post of ASD, which, in fact, was the promotional post for these categories as per the notified RRs and these persons were required to complete 5 years of regular service after having been converted into the grade of PEX for promotion to the post of ASD by holding DPC, subject to the availability of vacancies. Due to these frauds; on the one hand erstwhile casual contractual staff artist Sh.G.Jayalal (Science Officer = Pex) who was illegally encadred as ASD after 1984 in violation of the RRs, is presently holding the post of DG,AIR;.on the other hand, the regular UPSC recruited PEXs of 1977,1978,1980,1982,1983 are forced to work under persons like him and illegally regularised Science Officers /Prducer Gr I etc who entered in the system after 6.3.1982 and were regularised /promoted through illegal orders/ nexus . iii. It can be seen from the records that a number of persons who were working as Production Assistants as on 6-3-1982 and were required to be encadred with Trexes after the screening , but were encaderd with ASDs by violating all the relevant RRs and Cabinet decision of 1982. As can be seen from the combined eligiblity list of staff artists prepared by DG:AIR No. 16/12/89-SI (Vol III) dated 23.10.1989 , designation of many persons are missing/not indicated deliberately to hide this fraud on the constitutional system of recruitment set up by the Union of India. Further , to compound this fraud, many persons were either illegally allowed to enter the system after 6.3.1982 and in some cases illegally elevated to higher positions in 1985 by violating the amended notification of RRs of 1984. As on date, all promotions/encadrement and seniority positions in All India Radio and Doordarshan from 6.3.1982 till date are to be reviewed as per the directions of the Hon’ble J&K High Court and Principal Bench CAT Delhi referred above. As stated in State of Karnataka vs Uma Devi and Others (SLPCC 9103-9105 of 2001) “It is recognized that no government order , notification or circular can be substituted for the statutory rules framed under the authority of law.†Thus in the light of this Apex Court Constitutional Bench order , it is requested that the irregularities committed in the past by way of illegal appointments/encaderements/promotions/placements should be rectified forthwith by convening the Review DPC’s ordered by the Courts and the affected regular programme personnels should be given all consequential benefits retrospectively. Ref: Our Letter No. PSWA/2001/21 dt. 27.06.2001 Sir, With reference to the above, it may be pointed out that we had requested for convening Review DPC in the Cadre of PEXes from 1982 onwards in terms of Rule 4(A)(1)(f) of the Recruitment Rules in the same pattern as has been done in the cadre of ASD, while implementing the judgement dated 30.07.97 of J&K High Court, upheld by the Hon’ble Supreme Court in the matter of Md. Ashraf Lone. If is pertinent to mention here that the Department had convened the DPC in the Cadre of PEXes by taking 1:1 ratio between TREXes & erstwhile Staff Artists into account, whereas the concerned rule states that the ratio between these two categories should be determined by taking sanctioned strength in each cadre into account at the time of holding DPC. If the ratio is calculated as per this rule, it will deviate from 1:1 in favour of TREXes. Since this rule has been found legal and valid by the Hon’ble J & K High Court/Supreme Court, it has become final and absolute, and cannot be challenged in any other court of law. It is therefore requested that the irregularities committed earlier by taking the ratio of 1:1 in the promotion in the Cadre of PEXes into account should be rectified forthwith by convening the Review DPC in question. Principal bench of CAT New delhi has directed (on 11.12 2008) the department to provide a copy of the list before 13.1.09 ie before 15.1.09 when the next hearing of the contempt case in review DPC filed by AUPO & PSWA comes up for hearing. Name: DISILLUSIONED Shout! : All of us know pretty well now dat most or all of the DPCs for junior progamme staff like,TREX,PEX,ASD etc are held up due to some court case pending or finalization of d seniority lists of the cadre,though vacancies are available in almost all such cadres. The primary reason for the present mess appears to be very poor maintenance of seniority lists and cadre control. Is it not ironical to be in such a mess inspite of the fact that for most of the time since inception of AIR, the department has always been controlled by our own programme colleagues and all the senior positions were always occupied by them only ? It was obviously expected that being in total control, our own senior officers would take care of proper cadre management of their own junior colleagues. Thus, now, we juniors are paying the price for the poor management by our own senior colleagues. I hope that all the juniors realise this now & let us take all steps to get out of this mess at the earliest, which is not possible without the help, cooperation & a completely unified approach to tackle this crisis by all the factions of the Programme staff. After all these years of working adhoc the 206 trexs, pas and allied categories are promoted on a regular basis but "The promoted officers will be on probation for a period of two years from the dates of their regular appointment/assumption of charge. The annual probation reports on their work and conduct may be sent, in the prescribed proforma, to this Directorate in due course". Were not they reported upon during their adhoc period?! "These promotions are subject to the outcome of WP No. 7763/2006 in the High Court of Rajasthan". Will anyone clarify what this is about.
