One day before the opening date




The earnest money should be deposited along with the tenders in the appropriate form as per the tender documents. The tender shall be issued physically from the office of the concerned office up to 4.00 PM one day before the opening of tender on payment by demand draft drawn in the favour of undersigned (by designation) and payable at________ for Rs. 1000/- (One thousand only) (non-refundable) for each package. The authorized tender documents are available for inspection in the office of Executive Engineer Punjab Mandi Board, from 11.00 AM to 4.00 PM during office hours on all working days up to one day before the opening of tender. The tender document can also be downloaded from the web site www.mandiboard.nic.in/. If the bidder downloads the bidding documents from the internet he would have to pay the cost of bid documents along with bid documents and submit it in a separate envelope marked ‘cost of bidding document downloaded from internet’. The tender will be received in double envelope. If the date of opening of tenders is declared a holiday, tenders shall be opened on the next working day.

Tendering Process

The intending contractors / societies can view the detail of tender documents on website ‘www.mandiboard.nic.in’ or in the office of undersigned. The tender document can be obtained on making payment of non refundable fee of Rs……. from the office of undersigned on any working day from date to date . In addition to this the tender documents are also available as download documents on internet site ‘www.mandiboard.nic.in’. The bidder who downloads the tender documents from the internet site would have to pay the cost of tender documents and submit it in a separate envelope marked ‘cost of tender documents downloaded from the internet’. The downloaded document shall be printed on single side of “legal” size paper only. The bid document shall be accepted spiral bound only.

The contractual agencies will submit the necessary documents as under

Technical Bid in Envelope ‘A’ containing cost of bid document downloaded from internet, Earnest Money, Income Tax clearance/ PAN copy, Partnership deed or registration certification of the firm or company, copy of enlistment of contractor of appropriate class in Punjab Mandi Board and latest copy of challan for deposit of EPF of the employees.

Financial bid in Envelope ‘B’ shall contain percentage rate below/ percentage above / at par with the rates entered in the schedule of rates.

Both these envelope ‘A’ and envelope ‘B’ shall be placed in another bigger envelope clearly marking the name of agency and name of the work. The envelope shall be delivered physically in the concerned office and a proper printed receipt shall be issued by Superintendent/Accountant/Head Draughtsman of the office.

The tender committee on given date will open the technical bid first and evaluate the eligibility of the contractors. The financial bid will be only opened if the contractual agency fulfills conditions in Technical bid.

Eligibility Criteria

  1. The financial bid without earnest money will not be opened and will be returned in original to the agency without opening.

  2. The tenders on downloaded form, without tender document fee, will not be opened.

  3. The contractor should be enlisted in appropriate class in Punjab Mandi Board.

  4. Conditional tenders will not be entertained and are liable to be rejected

  5. The societies shall produce an attested copy of resolution of Co-Operative Dept.

  6. The jurisdiction of court will be at the place of office of concerned Executive Engineer.

1. In this agreement, words and expressions shall have the same meanings as are respectively assigned to them. as per the general conditions of contract hereinafter referred to.

2. The following documents shall be deemed to from and be construed as part of this Agreement:­

(i) The “Notice Inviting Tender” & “Instructions to Tenderers” as at Annexure ‘A’ to this agreement.

(ii) “Percentage Rate tender for works” at Annexure ‘B’ to this agreement.

(iii) “Conditions of contract’” as at Annexure ‘C’ to this agreement.

3. The work will be executed strictly according to specifications and drawings relating to the work as indicated in the “Notice Inviting Tender”. The schedule of items of work to be carried out will be as per approved “Notice Inviting Tender”. The material to be issued from Board stores for use on work will be as shown in the approved “Notice Inviting Tender”.

4. All correspondence and modifications of tendered offer and acceptance letter will form part of this Agreement.

5. In considerations of the payments to be made by the board to the contractor in respect of completed work, or item of work, the contractor hereby covenants with the board to execute the work in conformity in all respects with the provisions of this Agreement.

6. The Board hereby covenants to pay the contractor, in consideration of execution of works, the price in the manner as specified in this Agreement.

Notice Inviting Tender and Instructions to Tenders



1. Sealed Tenders in the prescribed form are hereby invited on behalf of the chairman Punjab mandi board for the for the ............................................................................................. .. .. .. ... ............................................................................................................................. at an estimated cost of Rs. ......................................in double envelop system.

2. Tender documents duly completed in all respects, signed on each page and placed in sealed cover, with the name of work and name of contractor written thereupon, will be received in the office of the undersigned upto ..................hrs.

3. The Tender will be received by the Executive Engineer ( ), Punjab Mandi Board ........upto ---- hrs. on Date.................. and tenders will be opened by tender committee on the same date and at ------ hrs in the presence of any Tenders or their agents who may like to be present .

5. The tenders should be in percentage above or below . For items not included in the said Schedule, but which may have to be executed to ensure completion as per drawings and specifications, the quoted percentage shall also apply to the relevant rates given in the “Common Schedule of Rates” for these items. Only one rate of percentage rate above .or below the rates exhibited in the “printed “Common Schedule of Rates” shall be quoted.

6. Earnest money amounting to Rs..............................must be furnished in the form of deposit at call /Fixed deposit Receipt / Demand Draft of a scheduled Bank in the name of the undersigned (by Designation) and enclosed with the tender. Any bid not accompanied with requisite earnest money in acceptable form shall be rejected. Bid shall not be opened without the receipt of Earnest money. The earnest money should be given in separate envelope.

7. The Contractor, whose tender is accepted shall be required to furnish security at the rate of five percent of the cost of the work by deduction from the running bills; (three percent of the total cost to cover liability of defects and shortcomings and two percent of the total cost for winding up the contract satisfactorily). The earnest money, if realised from the Bank will be treated as part of the security deposit.

8. The offer shall remain open for acceptance for a period of ninety days from the date of opening of the Tender. The earnest money shall be forfeited if the the tenderer withdraws or modifies his offer within the validity period or fails to sign the (formal contract) agreement after acceptance of his offer or fails to commence the work within ten days of issue of acceptance letter. After the forfeiture of earnest money, the contract shall be immediately nullified.­

9. On acceptance of the tender, the contractor shall either himself remain available at site of work or arrange the availability of an accredited representative, fully authorized in writing, at the site of work to receive instructions of the Engineer-In-Charge or his representative and to ensure prompt compliance thereof.

10. The undersigned does not bind himself to accept the lowest rate or any tender and reserves to himself, the right of accepting the whole or part of the tender and tendered shall be bound to perform the same at the quoted rates.

11. Sales tax or any other tax on the material or the turnover shall be payable by the contractor and the Punjab Mandi Board will not entertain any claim in this respect.

12. Before filling this tender, the contractor shall visit the site and satisfy himself as to the conditions prevalent there especially regarding accessibility to the site, nature and extent of the ground, working conditions, stacking of materials, installations of Tools and Plants etc. accommodation and movement of labour, supply of water and power for satisfactory completion of the works contract. No claim, whatsoever, on such accounts shall be entertained by the department in any circumstances.

13. The contractor shall comply with the provisions of the Apprentices Act, 1961, Minimum Wages Act, 1948, Workmen’s Compensation Act, 1923, Contract labour (Regulation and Abolition) Act, 1970,Payment of Wages Act, 1936, Employer’s Liability Act, 1938, , Maternity Benefits Act, 1961 and the Industrial Disputes Act, 1947 as applicable and the rules and regulations issued there under from time to time. Failure to do so shall amount to breach of the contract and the Engineer-in-charge may, at his discretion, terminate the contract. The contractor shall also be liable for any pecuniary liability arising on account of violation by him of the provisions of the Act.

14. The tender shall bear all costs associated with the preparation’ and submission of his tender and the department shall in no case be liable for these costs.

15. Each tender shall submit only one tender, either by himself or as partner in a joint venture. A tender who submits or participates in more than one tender, will be disqualified.

16. Unless otherwise stated, the contract shall be for the whole work as described in the “Schedule of Items of works” and the drawings. The contractor shall be bound to complete the whole work as described in the schedule of items of works’ and the drawings, including the additional items, if any, as per drawings and instructions. The certificate of completion as issued by the Engineer-in-charge shall be the conclusive proof of completion of work.

17. The tender shall be typed or written in indelible ink and shall be signed by the tender or a person or persons duly authorized to sign on behalf of the tender. All pages of the tender documents containing the entries and all corrections or amendments made therein shall be initialed by the person or persons signing the tender.

The following documents shall accompany the tender:

(i) Deposit at call, fixed deposits receipt/Demand draft for earnest money.

(ii) Income tax clearance certificate/pan copy

(iii) Partnership deed or Registration certification of the firm or Company as the case may be.

(iv) Copy of Enlistment of contractor of appropriate class by Punjab Mandi Board.

(v) Power of Attorney as required under rule for joint venture.

(vi) list of works executed and/or in progress with agreement cost.

(vii) list of machinery and list of staff (Technical and non-technical)

(viii) Allotted EPF CODE Number from Employees Provident Fund Commissioner, and latest copy of challan of Deposit of EPF of the employees.

18. Incomplete tender or tenders not fulfilling any of the conditions specified above, are liable to be rejected without assigning any reason.

19. Work programme- The contractor is required to access the requirement of man, material & machinery & submit work programme in which date of start and date of completion of every item of work is clearly laid down. It is desirable that a sample PERT-Chart of complete activity of construction should be drawn up wherein the detail of every large and small activity should be clearly shown. The Engineer in charge after checking that work programme is realistic shall accord his approval. It is imp. that the time period given for completion of different portions of work are properly checked with reference to availability of machinery and if necessary Engineer in charge should advise the contractor to redraw the work programme before according his approval.

20. Conditional Tender shall not be accepted.

ANNEXURE-C
CONDITIONS OF CONTRACT

.

1. The “Contract” means the documents forming the tendered offer and acceptance thereof consisting a binding contract between the Punjab Mandi board and the contractor, the tender documents including the conditions, the drawings, design, the specifications supplemented with instructions issued from time to time by the Engineer-in-Charge and shall be binding on the parties in the stated order of precedence. All these documents taken together with the tendered offer and its acceptance shall be deemed to form the contract and shall be complementary to one another.
2. The “Common Schedule of Rates” shall mean a printed document containing rates of different items of works pertaining to different Branches of P.W.D. i.e. Irrigation, B & R (Bldgs. & Roads Branch) and Public Health Branch and approved by the Committee of Direction of Chief Engineers of these P.W.D. Branches and Punjab Govt.
3. “Completed Works”. shall mean the work completed in all respects as per laid down specifications, drawings, approved N.I.T and to the entire satisfaction of Engineer-in-Charge.
4. The “Contractor” shall mean the individual or firm or company whether incorporated or not, undertaking the work and shall include the legal personal representative or the persons comprising such firm or company or the successors of such firm or company as well as the assignees of such individual or firm or company whose tendered offer has been accepted.
5. The completion date is the date when the Engineer-in-charge certifies that the work can be put to use, after receipt of intimation from the contractor regarding its completion.
6. “Communication” between parties are the written and signed letters, notices, reminders,

Memoranda and instructions recorded in the instructions book or books kept at site.
7. “Days & months” are calendar days and calendar months.
8. The “Engineer-in-charge” means the Executive Engineer who shall supervise the work and administer the contract with the assistance of his authorized subordinates who shall be in charge of the work and who shall sign the contract on behalf of the Punjab Mandi board
9. “The board shall mean the Punjab Mandi Board
10. The “Site” shall mean the land and or other places, or, into or through which work is to be executed under the contract or any adjacent land, path or street which may be allowed to be used for the purpose of carrying out the contract.
11. “Schedule of material” shall mean the list of materials which are to be issued from Board Store to the contractor for genuine use on the work as per Annexure-E.
12. The “Start date” is the date when contract came into existence upon the issue of “letter of acceptance” by the Engineer-in-charge.
13. “Schedule of items of works” shall mean the items of work to be executed at site of work pertaining to work allotted to the contractor.


  1. The “Works or work” shall, unless the context otherwise requires, mean what the contractor is required to execute and hand over to the board


Note : In interpreting these “Conditions of contract”, singular also means plural, male means female and vice versa.
