Test Guidelines

1 This document provides information on the following developments concerning Test Guidelines:

I. TEST GUIDELINES FOR ADOPTION


2 The Technical Committee (TC), at its forty-seventh session, held in Geneva from April 4 to 6, 2011, noted that the Council, at its forty-third ordinary session, held in Geneva on October 22, 2009, had endorsed the practice whereby Test Guidelines are adopted by the TC on behalf of the Council on the basis of the program of work approved by the Council, without the individual Test Guidelines being submitted to the Council for review (see document C/43/17 “Report”, paragraph 38).
3 At its forty-sixth ordinary session, held in Geneva on November 1, 2012, the Council noted the work of the TC, the Technical Working Parties (TWPs) and the Working Group on Biochemical and Molecular Techniques, and DNA-Profiling in Particular (BMT), as provided in document C/46/10, and approved the programs of work set out in document C/46/10 (see document C/46/18 “Report on the Decisions”, paragraph 38).
4 For the year 2012, one session was scheduled for each of the existing TWPs. At those sessions, it was decided to submit the draft Test Guidelines in Annex I to the TC for adoption.
5 The partial revisions for the following Test Guidelines are specified in the indicated documents:
• African Lily (document TG/266/1) (see document TC/49/37)

• Lettuce (document TG/13/10 Rev.) (see document TC/49/38)

Spinach (document TG/55/7 Rev.) (see document TC/49/39)

Tomato (document TG/44/11) (see document TC/49/40)


6 The TC is invited to adopt, subject to any changes proposed by the Enlarged Editorial Committee (TC-EDC):
(a) the draft Test Guidelines listed in Annex I to this document; and
(b) the partial revisions to the Test Guidelines, as listed in Annex I to this document, on the basis of the revisions set out in documents TC/49/37, TC/49/38, TC/49/39 and TC/49/40.

II. ADDITIONAL CHARACTERISTICS


7 At its forty-fifth ordinary session held in Geneva on October 20, 2011, the Council adopted the revision of document TGP/5 Section 10/1 “Experience and Cooperation in DUS Testing, Section 10: Notification of Additional Characteristics” on the basis of document TGP/5 Section 10/2 Draft 3 (see document C/45/17 “Report on the Decisions”, paragraph 12).
8 Document TGP/5 Section 10/2 “Experience and Cooperation in DUS Testing, Section 10: Notification of Additional Characteristics and States of Expression” states that:
“4.2 Proposals for additional characteristics and states of expression notified to the Office of the Union by means of document TGP/5 Section 10, will be presented to the relevant Technical Working Party(ies) (TWP(s)) at the earliest opportunity with information on the extent of use of the characteristic. The characteristics will then, as appropriate, be posted on the password-restricted area of the UPOV website (http://www.upov.int/restricted_temporary/twptg/en/drafters_kit.html), on the basis of comments made by the relevant TWP(s), and/or the TWP(s) may initiate a revision or a partial revision of the Test Guidelines concerned.”
9 At its eighty-second session held in Geneva on October 19 and on the morning of October 20, 2011, the Consultative Committee recommended to the Council, at its forty-fifth ordinary session, that documents currently in the first restricted area of the UPOV website be made publicly accessible, by removal of the password requirement. The Consultative Committee agreed that, if possible, the removal of the password be arranged to coincide with the launching of the redesigned UPOV website on November 1, 2011.
10 On the basis of the recommendations of the Consultative Committee, at its forty-fifth ordinary session, the Council agreed that documents currently in the first restricted area of the UPOV website be made publicly accessible, by removal of the password requirement. It also agreed that, if possible, the removal of the password be arranged to coincide with the launching of the redesigned UPOV website on November 1, 2011.
11 Following the developments above, the TC at its forty-eighth session, held in Geneva from March 26 to 28, 2012, agreed that, in the first instance, additional characteristics should be posted in the TG Drafters’ Webpage and that further consideration to the publication of additional characteristics on the general website could be considered at a later date (see document TC/48/22 “Report on the Conclusions”, paragraph 152).
12 Document TC/48/2 stated that, on the basis of the conclusion of the TC at its forty-eighth session, a version of document TGP/5 Section 10 would be prepared for consideration by the TC at its forty-ninth session (see document TC/48/2, paragraph 16). In that regard, the Consultative Committee is continuing discussions on the inclusion of disclaimers on UPOV documents and it is proposed to await the conclusion of those discussions before presenting a revision of document TGP/5 Section 10. Subject to the conclusion on that matter by the Consultative Committee, a draft revision of document TGP/5 Section 10 would be presented for consideration by the TC at its fiftieth session.
13 The TC is invited, subject to the conclusion of discussions on disclaimers on UPOV documents in the Consultative Committee, to agree that a draft revision of document TGP/5 Section 10 be presented for consideration by the TC at its fiftieth session.

III. CORRECTIONS TO TEST GUIDELINES


14 Corrections have been made to adopted Test Guidelines as follows:
Test Guidelines for Japanese Plum (document TG/84/4)
15 The denomination for the example variety “Black Diamond” has been corrected to “Suplumeleven” in the Table of Characteristics (characteristics 2, 10 and 41) as follows:

16 The TC is invited to note the correction made to the Test Guidelines for Japanese Plum (document TG/84/4 Corr.), as set out in paragraph 15.


IV. DRAFT TEST GUIDELINES DISCUSSED BY THE TECHNICAL WORKING PARTIES IN 2012


17 A list of Test Guidelines discussed by the Technical Working Parties in 2012 is presented in Annex II to this document.
18 The TC is invited to note the draft Test Guidelines discussed by the Technical Working Parties at their sessions in 2012, as listed in Annex II to this document.

V. DRAFT TEST GUIDELINES TO BE DISCUSSED BY THE TECHNICAL WORKING PARTIES IN 2013


19 For their sessions in 2013, it is proposed that the TWPs discuss the development of new Test Guidelines, or the revision of Test Guidelines, as listed in Annex III.
20 A summary table showing the status of the existing Test Guidelines, at the date of preparation of this document, is attached as Annex IV.
21 The TC is invited to:
(a) agree the program for the development of new Test Guidelines and for the revision of Test Guidelines, as shown in Annex III to this document; and
(b) note the status of the existing Test Guidelines, as listed in Annex IV to this document.

VI. TEST GUIDELINES ON THE UPOV WEBSITE
