Minutes of City Council

March 20, 2012

Regular Session
The Council of the City of Lewisburg met in regular session on Tuesday, March 20, 2012 at 7:30 p.m. in the Paul R. Cooley Council Chambers located at 942 Washington Street West.

PRESENT: Mayor John Manchester, Recorder Shannon Ninnemann, CMC; Councilmembers Josh Baldwin, Mark Etten, Joseph Lutz and Beverly White; Public Works Director Mark Carver; Zoning Officer Ken Tubbs; Treasurer Susan Honaker, Police Chief Tim Stover, Fire Chief Wayne Pennington.

ABSENT: Councilmember Andrew Evans

VISITORS: Reporters Heather Blake of the West Virginia Daily News, Peggy McKenzie of the Mountain Messenger, Tina Alvey of the Beckley Register-Herald; Ann Brown, Timothy Peregay, Suzanne Williams, Lauren & Paul Brenner and Kevin Hill.

CALL TO ORDER:

Mayor Manchester called the meeting to order at 7:30 p.m.



INVOCATION AND PLEDGE OF ALLEGIANCE:

Recorder Ninnemann gave the invocation and Councilmember White led the pledge of allegiance.



VISITORS REPORT:

No reports were given.



APPROVAL OF MINUTES:

February 21, 2012

Councilmember White made a motion to approve the February 21, 2012 regular session minutes as presented. Councilmember Etten seconded the motion. With four (4) in favor, one (1) absent (Evans) the motion carried.



March 6, 212

Councilmember White made a motion to approve the March 6, 2012 special session minutes as presented. Councilmember Etten seconded the motion. With four (4) in favor, one (1) absent (Evans) the motion carried.



COMMUNICATIONS FROM THE MAYOR:

Farmer’s Market Lease

Mayor Manchester asked the Lewisburg Farmer’s Market, President, Paul Brenner if the group had any concerns about the proposed lease. Brenner answered “no.” Manchester noted the City would need a copy of minutes of the Lewisburg Farmer’s Market indicating the Board had approved the lease before the City would sign the lease.

Councilmember Etten made a motion to enter into a lease agreement with the Lewisburg Farmer’s Market to operate a farmer’s market for one year on the Lewisburg United Methodist Church parking lot that the City uses as a municipal parking. Councilmember Baldwin seconded the motion. With four (4) in favor and one (1) absent (Evans) the motion carried.

RESOLUTIONS:

Resolution 390

Recorder Ninnemann read the title of the following resolution for passage:

“RESOLUTION OF THE CITY OF LEWISBURG APPROVING INVOICES RELATING TO ACQUISITION AND CONSTRUCTION AND OTHER SERVICES FOR THE RADIO READ METER PROJECT DRAW REQUEST EIGHT AND AUTHORIZING PAYMENT THEREOF”

Councilmember Etten made a motion to approve Resolution 390 as presented. Councilmember White seconded the motion. With four (4) in favor and one (1) absent (Evans) the motion carried.



Resolution 391

Recorder Ninnemann read the following resolution for passage:

WHEREAS, the Lewisburg City Council being aware of the recurring flooding and threat of flooding of storm water and the resulting damage to property located within Lewisburg; and,

WHEREAS, there is a desire and need for the program of insurance coverage for those who reside or hold title to property located within Lewisburg; and,

WHEREAS, relief is available in the form of flood insurance as authorized by the National Flood Insurance Act of 1968, as amended: and,

WHEREAS, the regulations declared by the Federal Insurance Administrator under said Act require:



  1. an official legislative or executive act indicating a local need for flood insurance and a desire to participate in the National Flood Insurance Program, and (2) assurances in the form of action by the appropriate local legislative body committing the local legislative body to certain future courses of action;

NOW THEREFORE, be it resolved by the Lewisburg City Council of the City of Lewisburg:

THAT, it will comply with the regulations of the National Flood Insurance Program:



  1. To recognize and duly evaluate flood, mudslide (ie., mudflow) and/or flood-related erosion hazards in all official actions in the areas having special flood, mudslide (i.e. mudflow) and/or flood-related erosion hazards and to take such other official action reasonably necessary to carry out the objectives of the program; and,

  2. To assist the Administrator at his/her request, in his/her delineation of the limits of the areas having special flood, mudslide (i.e. mudflow) or flood-related erosion hazards; and,

  3. To provide such information concerning present uses and occupancy of the flood plain, mudslide (i.e mudflow) or flood-related erosion areas as the administrator may request; and,

  4. To maintain for public inspection and furnish upon request, for the determination of applicable flood insurance risk premium rates within all areas having special flood hazards identified on a FHBM or FIRM, any certificates of flood proofing, and information on the elevation (in relation to mean sea level) of the level of the lowest floor (including basement) of all new or substantially improved structures, and include whether or not such structures contain a basement, and if the structure has been flood proofed, the elevation (in relation to mean sea level) to which the structure was flood proofed: and,

  5. To cooperate with Federal, State and local agencies and private firms which undertake to study, survey, map and identify flood plain, mudslide (i.e mudflow) or flood-related erosion areas, and cooperate with neighboring communities with respect to the management of adjoining flood plain, mudslide (i.e mudflow) or flood-related erosion areas in order to prevent aggravation of existing hazards; and,

  6. Upon occurrence, to notify the Administrator in writing whenever the boundaries of the community have been modified by annexation or the community has otherwise assumed or no longer has authority to adopt and enforce floodplain management regulations for a particular area. In order that all FHBMs and FIRMs accurately represent the community’s boundaries, include within such notification a copy of a map of the community suitable for reproduction, clearly delineating the new corporate limits or new area for which the community has assumed or relinquished flood plain management regulatory authority and,

  7. To appoint Mayor John Manchester with the responsibility, authority and means to implement the commitments made herein and to submit annually or biennially a report to the Administrator on the progress made during the past within the community in the development and implementation of flood plain management measures.

Adopted this 20th day of March, 2012.

Councilmember White made a motion to approve Resolution 391 as presented. Councilmember Baldwin seconded the motion. With three (3) in favor, one (1) opposed (Etten) and one (1) absent (Evans) the motion carried.



COMMUNICATIONS FROM CITY COUNCIL MEMBERS:

First Annual Literary Festival

Councilmember Baldwin announced that plans are underway for Lewisburg’s first Annual Literary Festival for the first weekend in August. He stated that he and Aaron Maxwell are co-chairs of the event.



Greenbrier East Girl’s Basketball Champs

Mayor Manchester unveiled an autographed basketball signed by the Greenbrier East High School basketball team and their coach Jim Justice. Manchester stated that the team had celebrated the team’s Class AAA state championship on Saturday, March 17 with a Champions Caravan. The Caravan paraded through Alderson, Ronceverte, Lewisburg and White Sulphur Springs. Manchester noted that the basketball would remain on display in City Hall.



Mayor R.B. Fouch, Jr. memorial service to be held

Mayor Manchester announced that former Mayor R.B. Fouch, Jr.’s memorial service was going to be held on Friday, March 23 at 1:00 p.m. at the Lewisburg United Methodist Church.



New restaurant open

Manchester stated that a new restaurant called The Barn and Grill had opened on North Court Street. He stated the restaurant would be open until 10:30 p.m. at night.



COMMUNICATIONS FROM BOARDS AND COMMISSIONS:

Planning Commission report

Zoning Officer Ken Tubbs reported on the following events of the March 1, 2012 Planning Commission meeting:



  • A minor subdivision request from Nancy C.T. Snodgrass on Fairview Road for Parcel 0003 on Greenbrier County Tax Map 9 was approved.

  • A request from Ream Interests, Inc. for a Doctrine of Merger for part of parcel 4 and parcel 2 in Gateway Commons on Greenbrier County Deed 526, page 119 Tax map 12, parcel 37 and Deed Book 545, page 690 Tax map 16, parcel 105 was approved.

  • A sketch plan for Autozone at 428 North Jefferson Street was reviewed.

Building and Zoning Annual Report

Zoning Officer Ken Tubbs presented the annual building and zoning report:

197 building permits were granted in 2011 at a value of $15,440,000 with $45,798 in fees collected. The Department also conducted a total of 511 inspections for the year.

Parks Commission Report

No report was given because Councilmember Evans was absent.



COMMUNICATIONS FROM THE POLICE DEPARTMENT:

Purdue Pharma Grant Application

Chief Stover requested permission to apply for a grant application from the Division of Criminal Justice Service to purchase a new vehicle for the K-9 unit that includes an insert for the dog to ride safely in the vehicle. The grant is designed to help law enforcement acquire needed equipment to deal with the volume of prescription drug arrests. Stover noted the grant required no match and the City would be reimbursed after expenses were paid.

Councilmember White made a motion to allow Chief Stover to apply for a Purdue Pharma grant for a grant that requires no match. Councilmember Etten seconded the motion. With four (4) in favor and one (1) absent (Evans) the motion carried.

COMMUNICATIONS FROM THE FIRE DEPARTMENT:
Fire Chief Pennington did not give a report.
COMMUNICATIONS FROM COUNCIL COMMITTEES:
Finance Committee Report
Councilmember Etten reported on the following events of the March 13, 2102 Finance Committee meeting:


  • The Committee recommended approval of the annual skunk contract with a contract price at $750 a month.

Councilmember Etten made a motion to approve the annual skunk control contract at $750 a month during “peak times” of June through October. Councilmember White seconded the motion. With four (4) in favor and one (1) absent (Evans) the motion carried.



  • Committee recommended approval a $10,500 contract to produce “A Road Trip to History Video” featuring Lewisburg. The videos would be broadcast on PBS and DVD’s would be available to sell.

Councilmember Etten made a motion to allow City Administrator Manchester to enter into a contract in the amount of $10,500 to produce “A Road Trip to History” video featuring Lewisburg. Councilmember White seconded the motion. With four (4) in favor and one (1) absent (Evans) the motion carried.


  • The Committee made a recommendation to authorize the Public Works Director to purchase a 2012 GMC Canyon Truck at a cost of $18,950.66.

  • The Committee recommended approval of the Fiscal year 2013 General Fund Budget.

Councilmember Etten made a motion to approve the 2013 Fiscal Year General Fund Budget. Councilmember Baldwin seconded the motion. With four (4) in favor and one (1) absent (Evans) the motion carried.




  • The Committee recommended approval of the 2013 Fiscal Year Coal Severance Fund Budget.

Councilmember Etten made a motion to approve the 2013 Fiscal Year Coal Severance Fund Budget. Councilmember Baldwin seconded the motion. With four (4) in favor and one (1) absent (Evans) the motion carried.


Public Works Committee Report
Councilmember White reported on the following events of the March 13, 2012 Public Works Committee meeting:


  • The completion of the walking trail was discussed.

  • The Radio Read draw request was discussed.

  • The Lee Street Underline water line replacement project which is slated to begin in April was discussed.


Public Safety Committee Report
Councilmember Lutz reported on the following events of the March 7, 2012 meeting:


  • Chief Pennington presented the 15 year strategic plan of the Fire Department.

  • The DARE officer is going to begin discussing the new prescription drop box at the Courthouse with parents.


ADJOURNMENT:
Councilmember Lutz made a motion to adjourn the meeting at8:27 p.m. Councilmember White seconded the motion. With four (4) in favor and one (1) absent (Evans) the motion carried.
