INDEPENDENT Gambling Authority, having made Rules under section 62 of the Authorised Betting Operations Act 2000 on 6 February 2009, hereby publishes those Rules for the purposes of section 11 of the Subordinate Legislation Act 1978.

AUTHORISED BETTING OPERATIONS ACT 2000
No. 1 of 2009
Rules to remove a prohibition on betting exchanges and amend the advertising and responsible gambling codes of practice applying to licensed bookmakers and for other purposes
Bookmakers Licensing (Amendment) Rules 2009
[6 February 2009]

The Independent Gambling Authority makes the following rules:



1. Citation, commencement

(1) These rules may be cited as the Bookmakers Licensing (Amendment) Rules 2009.

(2) The Bookmakers Licensing Rules 2000* are referred to in these rules as “the Principal Rules”.

(3) These rules come into operation on the same day as section 11 of the Statutes Amendment (Betting Operations) Act 2008.

(4) These rules are made under section 62 of the Authorised Betting Operations Act 2000.

2. Amendments relating to betting exchanges

(1) In rule 2 (1) of the Principal Rules, the definition of “betting exchange” is omitted.

(2) Rule 30 of the Principal Rules is revoked.

(3) After rule 140 of the Principal Rules, insert



“141. Transitional (Betting Exchanges)

The revocation of rule 30 by the Bookmakers Licensing (Amendment) Rules 2009 does not preclude—

(a) the continuation of a prosecution or a process founded on a statutory default; or

(b) the commencement of a prosecution or a process founded on a statutory default—

in respect of a breach of rule 30 occurring prior to that revocation.”.

3. Amendments relating to responsible gambling by bookmakers

(1) The following provisions of the Principal Rules are revoked:

(a) rule 4;

(b) rule 5;

(c) rule 6;

(d) Schedule 3.

(2) In rule 6A of the Principal Rules—

(a) for “must include” substitute “must, in respect of betting operations conducted by telephone, Internet or other electronic means, include”;

(b) after paragraph (b), insert


“—

which are consistent with the code of practice prescribed under section 6A of the Act for the purposes of section 60B of the Act.”.

NOTE

1. Rule 1 (3)—commencement: For the purposes of section 10AA(2) of the Subordinate Legislation Act 1978, the Minister for Gambling certified on 5 February 2009 that, in the Minister’s opinion, it is necessary or appropriate that these Rules come into operation as set out in rule 1 (3).

BUILDING WORK CONTRACTORS ACT 1995

Exemption

TAKE notice that, pursuant to section 45 of the Building Work Contractors Act 1995, I, Mal Hemmerling, Commissioner for Consumer Affairs, do hereby exempt the licensee named in Schedule 1 from the application of Division 3 of Part 5 of the above Act in relation to domestic building work described in Schedule 2 and subject to the conditions specified in Schedule 3.

Schedule 2

Construction of a house on land situated at Lot 47, Goode Street, Goolwa, S.A. 5214 (Allotment 47 in Deposited Plan 78243 in the area named Goolwa, Hundred of Goolwa (certificate of title volume 6020, folio 241)).

Schedule 3

1. This exemption is limited to domestic building work personally performed by the licensee for the construction of a house on land situated at Lot 47, Goode Street, Goolwa, S.A. 5214 (Allotment 47 in Deposited Plan 78243 in the area named Goolwa, Hundred of Goolwa (certificate of title volume 6020, folio 241)).

2. This exemption does not apply to any domestic building work the licensee sub-contracts to another building work contractor, for which that contractor is required by law to hold building indemnity insurance.

3. That the licensee does not transfer his interest in the land prior to five years from the date of completion of the building work the subject of this exemption, without the prior authorisation of the Commissioner for Consumer Affairs. Before giving such authorisation, the Commissioner for Consumer Affairs may require the licensee to take any reasonable steps to protect the future purchaser(s) of the property, including but not limited to:

• providing evidence that an adequate policy of building indemnity insurance is in force to cover the balance of the five-year period from the date of completion of the building work the subject of this exemption;

• providing evidence of an independent expert inspection of the building work the subject of this exemption;

• making an independent expert report available to pros-pective purchasers of the property; and

• giving prospective purchasers of the property notice of the absence of a policy of building indemnity insurance.

CROWN LANDS ACT 1929: SECTION 5

TAKE NOTICE that pursuant to the Crown Lands Act 1929, I, JAY WEATHERILL, Minister for Environment and Conservation, Minister of the Crown to whom the administration of the Crown Lands Act 1929 is committed DO HEREBY:

1. Resume the land defined in The First Schedule.

2. Dedicate the Crown Land defined in The Second Schedule as a Reserve for Water Conservation Purposes and declare that such land shall be under the care, control and management of The District Council of Kimba.

PURSUANT to section 28 (1) of the Development Act 1993, I, Paul Holloway, Minister for Urban Development and Planning, am of the opinion that it is necessary in the interest of the orderly and proper development of the area affected by the ‘District Council of Tumby Bay—General and Coastal Development Plan Amendment’ that the Plan Amendment should come into operation without delay on an interim basis on 12 February 2009.

can formally object in writing to the Electoral Commissioner by close of business on 13 March 2009. Objections must contain the postal address and signature of the objector.

ENVIRONMENT PROTECTION ACT 1993



Revocation of Approval of Category B Containers

I, ANDREA KAYE WOODS, Team Leader, Container Deposit Legislation and Delegate of the Environment Protection Authority (‘the Authority’), pursuant to section 68 of the Environment Protection Act 1993 (SA) (‘the Act’) hereby revoke the approvals of the classes of Category B Containers sold in South Australia as identified by reference to the following matters, which are described in the first 4 columns of Schedule 1 of this Notice:



(a) the product which each class of containers shall contain;

(b) the size of the containers;

(c) the type of containers; and

(d) the name of the holders of these approvals.

These approvals are revoked as the Authority is satisfied that the waste management arrangement between the approval holder and the party named in Column 5 of Schedule 1 of this Notice has been cancelled.
