Preamble

Pursuant to section 27 (3) (b) of the Development Act 1993, the Environment, Resources and Development Committee of Parliament has suggested amendment to the Angaston (DC), Barossa (DC), Kapunda (DC), Light (Outer Metropolitan) (DC) and Tanunda (DC) Development Plans, as amended by the Barossa Valley Region—Industry—Plan Amendment, authorised on 30 September 1999.

Following this, pursuant to section 27 (5) (a), it is necessary to amend the above Development Plans (dates as shown below).

PURSUANT to section 27 (5) of the Development Act 1993, I, the Governor with the advice and consent of the Executive Council, declare the amendment, as attached, to be an authorised amendment to the:

FISHERIES ACT 1982: SECTION 59

TAKE notice that pursuant to section 59 of the Fisheries Act 1982, Rolf Czabayski, 5 Willowbridge Grove, Burnside, S.A. 5066 (hereinafter referred to as the ‘permit holder’) is exempt from regulation 35C of the Fisheries (General) Regulations 1984, in that the permit holder shall not be guilty of an offence when using berley within the waters specified in Schedule 1 to attract white sharks (Carchardon carcharias) for the purpose of cage viewing only (hereinafter referred to as the ‘permitted activity’), subject to the conditions specified in Schedule 2, for the dates specified in Schedule 3.



Schedule 1

Coastal waters contained within the Neptune Islands Conservation Park, and the following portions of the Sir Joseph Banks Islands Conservation Park; Dangerous Reef, English and Sibsey Islands.

Note: A maximum of 15 days per calendar month is permitted at Dangerous Reef which requires consultation with other approved operators through the Great White Shark Cage Viewing Association. During Australian Sea lion breeding periods, permits will not be provided for 8 months. This period will begin 8 weeks after the appearance of the first pups. Dates of this period will be provided to operators when determined by Department for Environment, Heritage and Aboriginal Affairs.

Schedule 2

1. The permit holder must be on board the boat when conducting the permitted activity.

2. All berley used while conducting the permitted activity must consist of fish based products only. All berley (other than fish oil) must be stored below a maximum temperature of 4C.

3. The permit holder must notify the public by a Notice to Mariners through the Australian Maritime Safety Authority, by public notice in the Adelaide Advertiser at least 24 hours in advance of berleying operations, advising the local coastguard and the Fisheries Compliance Unit on 1800 065 522 at least two hours prior to conducting the permitted activities.

4. The permit holder shall allow an officer of the Department for Environment, Heritage and Aboriginal Affairs (DEHAA) or nominee to be present on board the boat during the permitted activities if requested and subject to negotiation and availability of space.

5. The permit holder must comply with all instructions (including ceasing to berley if so instructed) given by an officer from DEHAA.

6. Whilst engaged in the permitted activity, a pennant (approved by DEHAA) must be flown from the boat so as to be clearly visible.

7. Whilst engaged in the permitted activity the permit holder must have in his/her possession a copy of this notice and produce a copy of the notice if required by a Fisheries Compliance Officer.

8. The permit holder shall not contravene or fail to comply with the Fisheries Act 1982, or any regulations made under the Act, except where specifically exempted by this notice.

9. The permit holder must maintain a log whilst engaged in the permitted activity which includes the date and location, number of passengers, number of hours berleying, number of sharks observed and any other relevant observations or comments. Records must be kept in a form determined by the operators association in conjunction with CSIRO Marine Research Unit and endorsed by the Minister for Environment and Heritage. A copy of the log must be provided to the relevant DEHAA office within 14 days of each calendar month. Failure to submit a log within the agreed time period may preclude the provision of future permits until such outstanding logs are received by the relevant DEHAA office.

10. The permit holder must conform to a code of ethics developed by the operators association and endorsed by the Minister for Environment and Heritage.

11. The permit holder will operate in cooperation with and in agreement of any other approved operator at the same location.

12. The permit holder must have public liability insurance to an amount determined by the Minister for Environment and Heritage and ensure vessels are surveyed and staffed as per Department of Transport regulations.

NOTICE is hereby given pursuant to section 6 (2) (b) of the National Electricity Law which forms the Schedule to the National Electricity (South Australia) Act 1996 and Clause 9.1.1 (h) of the National Electricity Code approved under section 6 of the National Electricity Law, that clauses 9.32.1, 9.34.1, 9.35.1, 9.35.3, 9.35.4, 9.35.5, 9.35.6, 9.35.8, 9.35.9(a), (b), (c), (d), (e) and (g), 9.36.1, 9.36.2, 9.36.5, 9.37.12, 9.37.14, 9.37.15, 9.37.18, 9.37.19 and 9.41 (Queensland Derogation amendments to accommodate market network services) of the National Electricity Code are amended.

These amendments to the National Electricity Code commence on 14 January 2000.

As required by clause 9.1.1 (h) of the National Electricity Code, a copy of the ACCC’s letter dated 9 December 1999 is set out below.

Interim Authorisation of the Queensland MNSP

Derogation Amendments

In your application of 15 November 1999, you sought authorisation (Nos A90725, A90726 and A90727) of amendments to the Queensland derogations to the National Electricity Code to allow market network services to participate in the Queensland market. At that time, you sought interim authorisation of the amendments to the derogations in order to facilitate the introduction of DirectLink which is anticipated to come on stream in January next year.

At its meeting on 8 December 1999, the Commission agreed to provide interim authorisation of the amendments to Queensland’s derogations, but not to the amendments to clauses 9.35.6A and 9.35.9(f), as set out in your 15 November 1999 application. The Commission also determined that the interim authorisation would lapse upon the Commission making a final determination.

As you may be aware, clauses 9.35.6A and 9.35.9(f) deal with Queensland’s rate of change arrangements and the amendments would place a market network service provider on equivalent


terms to a generator. However, in the Commission’s draft determination, dated 8 October 1999, the Commission proposed imposing a condition of authorisation requiring the clauses dealing within Queensland’s rate of change arrangements be deleted from the Code.

As these matters are still under consideration pending a final determination, the Commission decided not to consider interim authorisation of the amendments to the clauses 9.35.6A and 9.35.9(f) at this time. The Commission will reconsider interim authorisation of these amendments at the time the Commission makes its determination on authorisation Nos A90671, A90672 and A90673.

Notices under National Electricity Law and National

Electricity Code

NOTICE is hereby given pursuant to section 6 (2) (b) of the National Electricity Law which forms the Schedule to the National Electricity (South Australia) Act 1996 and clause 8.3.9 (d) of the National Electricity Code approved under section 6 of the National Electricity Law that clauses 3.14A and 3.9.2(e)(3) relating to Y2K events are withdrawn from the National Electricity Code to reflect that the ACCC authorisation of those provisions lapsed on 10 January 2000 and accordingly, such provisions are no longer valid.

This withdrawal of provisions of the National Electricity Code commences on 13 January 2000.

1. Section 4 (3) of the Supported Residential Facilities Act 1992, provides that the Minister may, by notice in the Gazette, confer various exemptions from the Act, or from provisions of the Act.

2. A notice of exemption was published in the Gazette on 5 June 1997 (see Gazette 5 June 1997, pp. 2810 and 2811).

3. It is now appropriate to vary that exemption pursuant to section 4 (8) of the Act.

WATER RESOURCES ACT 1997



Declaration of Penalty in Relation to the Unauthorised

Taking of Water

I, DOROTHY KOTZ, Minister for Environment and Heritage, to whom administration of the Water Resources Act 1997 (the Act) is committed, hereby declare that pursuant to section 132 of the Act, the following penalties are payable in relation to the unauthorised taking of water:

1. Where a licensee takes water from a prescribed well in the Northern Adelaide Plains Prescribed Wells Area in excess of the water allocation endorsed on a water licence:

(a) A rate of 20 cents per kilolitre for all water taken in excess of the water allocation endorsed on the licence, up to and including an amount equal to 115% of the water allocation endorsed on the water licence; and

(b) A rate of 90 cents per kilolitre for all water taken in excess of 115% of the water allocation endorsed on the water licence.

2. Where a licensee takes water from the River Murray Prescribed Watercourse or from a prescribed well in the Angas Bremer Prescribed Wells Area in excess of the water allocation endorsed on the water licence:



(a) A rate of 5 cents per kilolitre for water taken in excess of the water allocation endorsed on the water licence, up to and including an amount equal to 110% of the water allocation endorsed on the water licence; and

(b) A rate of 10 cents per kilolitre for water taken in excess of 110% of the water allocation endorsed on the water licence, up to and including an amount equal to 120% of the water allocation endorsed on the water licence; and

(c) A rate of 25 cents per kilolitre for all water taken in excess of 120% of the water allocation endorsed on the water licence.

3. Where water is taken by a licensee from a prescribed well in the Barossa Valley Prescribed Wells Area or from a Barossa Valley Prescribed Watercourse, in excess of the water allocation endorsed on the water licence:

A rate of 88 cents per kilolitre for all water taken in excess of the water allocation endorsed on the water licence.

4. Where water is taken from any prescribed water resource by a person who is not the holder of a water licence and who is not authorised under section 11 of the Act to take the water:

A rate of 88 cents per kilolitre of water determined or assessed to have been taken in accordance with secton 126 of the Act.

This notice has effect for the financial year commencing on 1 July 1999.
