2.heritage overlays ho122 alexandra avenue precinct and ho355 caroline street precinct – corrections to schedules of buildings

Purpose
The purpose of this report is to make corrections to the addresses, grading and descriptions of some buildings in Heritage Overlay Precincts HO122 and HO355.
Background
The land in these precincts was originally included in the Heritage Overlay in 1988 as the Alexandra Avenue Urban Conservation Area. This precinct was identified for a citation review as part of the Heritage Review Action Plan adopted in 2006. A review was undertaken in 2011-12 (as part of Amendment C157) and recommended that the precinct be split into two separate precincts (HO122 Alexandra Avenue Precinct and HO355 Caroline Street Precinct). As part of the review a more comprehensive citation was prepared and some boundary changes were made. It was decided not to change the gradings of the individual buildings as part of the amendment.
Council officers have since become aware of some errors in relation to the addresses and translation of the gradings and descriptions of eight properties in these precincts.
Discussion
Over the years several different studies have used different gradings systems and may have applied different gradings to the same property. In 2010-11 Council officers undertook an exercise to rationalise the gradings for all of the 8700 properties in the Heritage Overlay. Where the grading was the same in each study this grading was adopted. If the grading varied between the studies, Council’s heritage advisor made a site visit and confirmed the appropriate grading for that property and this became the ‘unified grading’ for that property. The Unified Gradings were adopted by Council in April 2012.
Council officers have become aware of errors in the addresses, grading and description of several properties in the Schedules of Buildings for HO122 and HO355 adopted with Amendment C157. Some errors may be due to the fact that the Amendment C157 review occurred prior to Council’s adoption of the Unified Gradings and that the gradings for the relevant precinct may not have been finally rationalised. Other errors are due to addressing anomalies or new building construction since the time of the review and it is considered that these should be corrected at the same time.
The following discussion lists the properties where errors have been identified (shown as strike-through), and the recommended corrected wording (shown in bold italics).
Incorrect gradings and descriptions
The following properties were graded B in the 1983 Conservation Study and included in the Planning Scheme as part of the Alexandra Avenue Precinct in 1988. However as part of Amendment C157 some errors were made in the translation of the gradings and descriptions. Council’s heritage consultant has since confirmed that 268, 270 and 272 Domain Road contain interwar villas and should be B graded. No 268A is a newly constructed lot and development. The recommended corrections are as follows:

  • 268 Domain Road, Ungraded, B grade, Modern villa c 2006, Interwar villa.

  • 268A Domain Road, Ungraded, Interwar villa, Modern villa c 2006

  • 270 Domain Road, A2 grade, B grade, Interwar villa

  • 272 Domain Road, Ungraded, B grade, Interwar villa


Omitted property
49A Darling Street is a newly created lot at the rear of 286 Domain Road. At the time of the Am C157 review this was a vacant site. The building is now constructed. It is recommended that it be included as:


Incorrect addresses
Some properties have new addresses or addresses that do not precisely align with Council’s Rates Data base. The following corrections are recommended:

Letters have been sent to the owners (except those affected only by address changes) advising them of the corrections and offering one-on-one consultations. It should be noted that only two properties (268 and 272 Domain Road) are affected by increased gradings. Any consultation feedback will be reported at this meeting.


Policy Implications
The implementation of Council’s adopted Heritage Strategy Action Plan is consistent with the following Council Plan strategy:

'Celebrate the municipality's heritage and diverse buildings by balancing its existing character with complementary and sustainable developments'.
Financial and Resources Implications
There is no requirement for a planning scheme amendment to change the schedule of buildings to a citation in this case and no costs will be incurred.
Legal Advice and Implications
Council’s heritage citations and schedules of building gradings and descriptions are ‘reference documents’ to the Planning Scheme. They are not incorporated documents and do not have legal status as part of the Planning Scheme. However any change or error correction should be made in consultation with the owner and by a Council resolution.
Conclusion
Council officers have become aware of some errors in the Schedule of buildings for Heritage Overlays HO122 Alexandra Avenue and HO355 Caroline Street Precinct) adopted as part of a recent review of these precincts in Amendment C157. Eight properties are affected. One was missing (being a newly created lot at the rear of another lot and which was vacant at the time of the review), one has a new address, two have minor address corrections, three are incorrectly graded and two have incorrect descriptions.
The consultant was required to use existing gradings. However variable gradings were applied in several previous studies and the review was undertaken at the time when the gradings rationalisation exercise had not been completed. Hence there was some confusion and some errors made in the translation of the gradings and descriptions. The correct ‘unified’ grading and description has now been confirmed in each case. In one case the grading has decreased and in two cases it has increased.

Human Rights Consideration

This recommendation complies with the Victorian Charter of Human Rights and Responsibilities Act 2006.


Recommendation
That Council:


  1. Adopt revised Schedules of Buildings for Heritage Overlays HO122 Alexandra Avenue Precinct and HO355 Caroline Street Precinct as attached.




  1. Advise the affected owners of the corrections to gradings and descriptions contained in the revised Schedules of Buildings for Heritage Overlays HO122 Alexandra Avenue Precinct and HO355 Caroline Street Precinct, as attached, being for:

  • 49A Darling Street, South Yarra

  • 268, 268A, 270 and 272 Domain Road, South Yarra
