3.4.3 Identification of Special-Status Species in the Action Area
To comply with the requirements of the California ESA, Federal ESA, and NCCPA, special-status species have been identified for evaluation. Species were selected according to the following criteria:


  • Affected directly or indirectly by construction or operation of the proposed fish screen; are MSCS covered species identified in the programmatic biological opinions (BOs) and NCCP approval for the CALFED Program;

  • Listed as threatened or endangered under either the California or Federal ESAs; are proposed for listing;

  • Candidates for listing;

  • Identified to have associated essential fish habitat (EFH) by NOAA Fisheries;

  • Plants listed as rare under the California Native Plant Protection Act;

  • California species of special concern;

  • Plants included on California Native Plant Society (CNPS) List 1A, 1B, 2, or 3; or

  • Native species of concern under the CALFED Program.

The species addressed in this EA/Initial Study were identified with the assistance of USFWS, NOAA Fisheries, and CDFG personnel during the planning process for this project. An official list of Federally endangered and threatened species that may be affected by projects in the Kirkville 7.5-minute topographical quadrangle was obtained from the USFWS web site (Appendix A). This list of species with occurrences in the USGS quadrangle in which the Proposed Project is located was then modified to reflect results of habitat analyses and field surveys of habitat as described below.


For purposes of analysis, the Action Area was defined as the area in which direct or indirect environmental consequences would likely occur. For the USFWS species listed for the Kirkville 7.5 minute quadrangle, the Action Area is functionally defined as:


  • For fish: the area approximately 300 meters upstream and downstream of the four facilities which would be affected by underwater noise and suspended sediment/turbidity during construction/demolition activities;

  • For nesting raptors: the area within approximately 0.5 mile of the four facilities which could be affected by construction noise and visual disturbance of nesting birds during construction/demolition activities;

  • For nesting resident and migratory songbirds: the area within100 feet (30 meters) of suitable trees-shrub nesting habitat;

  • For upland, ground nesting, and aquatic species: the area within the construction right-of-way for construction and demolition of pumping facilities, for construction and modification of irrigation canals, and for excavation of borrow; also the construction access roads; and

  • For valley elderberry longhorn beetle: the area within 100 feet (30 meters) of elderberry shrubs with a stem diameter of 1 inch or greater at ground level.

In addition to the list provided by the USFWS, a quadrangle-by-quadrangle review of records in the 2001 and 2004 California Natural Diversity Database was undertaken. This review was followed up by a series of field surveys (2001, 2004, and March of 2005). These surveys extended well beyond the immediate footprint of the Proposed Project. The scope of literature review and field surveys for plant and wildlife species conducted in the vicinity of the Proposed Project site is summarized on Table 3-1.

Data from RD108 Wilkins Slough Pumping Plant studies of species occurrence and susceptibility to entrainment used to evaluate potential for fish species occurrence and environmental effects.
