Mining (Revocation of Private Mine) Proclamation 2009

under section 73N of the Mining Act 1971

Preamble

1 The following area was declared to be a private mine by proclamation on 23 January 1975 (Gazette 23.1.1975 p258):

That piece of land being portion of section 66, hundred of Mobilong, county of Sturt being portion of the land contained in certificate of title register book, volume 3720, folio 165 and described as follows.

Commencing at a point on the most westerly boundary of land included in the aforementioned certificate of title and distant 44.42 m southerly from a bend of angle of 134° 55', thence northerly along the said westerly boundary to the said bend of angle of 134° 55', thence north easterly at an eastern angle of 134° 55' to the southern boundary of Jaensch Road, thence north easterly along the said boundary of Jaensch Road for 127.00 m, again north easterly along the said boundary at a north western angle of 179° 34' for 109.12 m, thence south easterly at a south western angle of 90° for 150 m, thence south westerly to the point of commencement.

2 The Warden's Court has declared (on 2 December 2008 in Action No 265 of 2008) that proper grounds exist for revoking the declaration referred to in clause 1.

1—Short title

This proclamation may be cited as the Mining (Revocation of Private Mine) Proclamation 2009.



2—Commencement

This proclamation comes into operation on the day on which it is made.



3—Revocation of private mine

The declaration referred to in clause 1 of the preamble is revoked.

Preamble

1 The following area was declared to be a private mine by proclamation on 19 July 1973 (Gazette 19.7.1973 p286):

Portions of block 5 and portion of block 6 of the subdivision of section 2001, hundreds of Kanmantoo and Monarto, county of Sturt, being all the land comprised and described in certificate of title, register book, volume 3765, folio 126, the aforesaid land being also portion of the land comprised and described in certificate of title, register book, volume 3048, folio 172.

2 The Warden's Court has declared (on 4 November 2008 in Action No 280 of 2008) that proper grounds exist for revoking the declaration referred to in clause 1.



1—Short title

This proclamation may be cited as the Mining (Revocation of Private Mine) Proclamation 2009.



2—Commencement

This proclamation comes into operation on the day on which it is made.



3—Revocation of private mine

The declaration referred to in clause 1 of the preamble is revoked.

CITY OF HOLDFAST BAY



Representation Review—Extension of Deadline

NOTICE is hereby given that the City of Holdfast Bay, pursuant to section 12 (7) of the Local Government Act 1999, is conducting a review to determine whether alterations are required in respect to elector representation, including ward boundaries and the composition of Councils.

Holdfast Bay is currently divided into four wards, each represented by three councillors. The mayor is elected from across the whole City. This review explores whether this structure still meets the needs of electors. An Options Paper has been prepared which considers different models including fewer councillors, as well as possible changes to ward boundaries.

This paper is available, free of charge, from the Council’s Customer Service centres in Glenelg and Brighton and can be downloaded from Council’s website at www.holdfast.sa.gov.au.

Written comments, addressed to the Chief Executive Officer, City of Holdfast Bay, P.O. Box 19, Brighton, S.A. 5048, now need to be received by Wednesday, 11 March 2009. All comments will be considered by Council at its meeting on Tuesday, 24 March 2009.

DISTRICT COUNCIL OF TUMBY BAY

Development Act 1993

General and Coastal Development Plan Amendment—Draft for Public Consultation and Interim Operation

NOTICE is hereby given that the District Council of Tumby Bay has prepared a draft Development Plan Amendment (DPA) to amend its current Development Plan. The Development Plan Amendment will amend the Development Plan by:

• Converting the existing Development Plan to the Better Development Plan format which includes the replacement of general and Council-wide policy with a range of general policy modules and the replacement of existing zone names and zone policy with new zone names and policy suitably amended to meet local circumstances.

• Redefining the boundary of the Coastal Conservation Zone to ensure that the outcomes sought in the Eyre Peninsula Coastal Development Strategy are more readily achieved.

• Introduction of more proscriptive provisions related to any form of development within the Coastal Conservation Zone including the listing of dwellings as non-complying development within the newly defined zone, new restrictions upon small scale tourist development while allowing for the development of ‘iconic’ tourist developments to occur as long as they are located at least 25 km from similar development.

• Creation of a Deferred Urban Zone to the south of the Tumby Bay township to include the area locally known as the ‘Island’.

• Minor modification to the boundary of the Caravan Park Zone (formerly Tourist Accommodation Zone) in Tumby Bay and introduction of restrictions upon any form of land division within the zone whereas previously land division was allowed as long as no additional lots were created.

• The inclusion of ‘dwelling’ except for a caretaker’s dwelling in the non-complying list for the Tumby Bay Commercial Zone.

• Introduction of more suitable set-back requirements for dwellings in the Cape Burr, Mottled Cover and Elfrieda Policy Areas of the Residential Zone.

• Introduction of prohibition concerning the cultivation of olives in the Primary Production Zone (formerly Rural Zone) within 500 m of parks and native vegetation.

• Minor changes to lists of non-complying development in various zones.

• Revision of policy within the Water Protection Zone to now restrict subdivision where this might relate to the provision of an allotment for a relative or employee or a retiree upon the land.

In order to prevent inappropriate development and promote orderly planning, the draft DPA has been granted ‘interim authorisation’ by the Minister, giving the amendment immediate effect.

The draft DPA will be available for public inspection and purchase during normal office hours at the Council Offices, Mortlock Street, Tumby Bay and will be available on Council’s website at www.tumbybay.sa.gov.au from Thursday, 12 February 2009 to Thursday, 16 April 2009. A CD-ROM copy of the DPA can be purchased from Council’s offices for $5.

Written submissions regarding the draft amendment will be accepted by the Tumby Bay District Council until 5 p.m. on Thursday, 16 April 2009. Electronic submissions may also be accepted at dctblaurie@bigpond.com. All written submissions should also clearly indicate whether you wish to speak at the public meeting regarding your submission. All submissions should be addressed to the Chief Executive Officer, E. A. Roberts, P.O. Box 61, Tumby Bay, S.A. 5605.

21 April 2009, in the Council Chambers, District Council of Tumby Bay, Mortlock Street, Tumby Bay. This public meeting may not be held if no submission indicates an interest in speaking at the public meeting.
