Motor Vehicles (Approval of Motor Bikes and Motor Trikes) Notice 2009
under the Motor Vehicles Act 1959
1—Short title
This notice may be cited as the Motor Vehicles (Approval of Motor Bikes and Motor Trikes) Notice 2009.
2—Commencement
This notice will come into operation on the date of publication in this Gazette.
3—Approved motor bikes and motor trikes
For the purposes of Schedules 2 and 3 of the Motor Vehicles Regulations 1996 and the transitional provisions of the Motor Vehicles Variation Regulations 2005 (No. 233 of 2005), the motor bikes and motor trikes specified in Schedule 1 are approved.
Schedule 1—Approved motor bikes and motor trikes
1—Motor bikes and motor trikes with an engine capacity not exceeding 260 ml
All motor bikes and motor trikes with an engine capacity not exceeding 260 milliliters and a power to weight ratio not exceeding 150 kilowatts per tonne other than the following:

Kawasaki KR250 (KR-1 and KR1s models)
Honda NSR250
Yamaha TZR250
Aprilia RS250
2—Motor bikes and motor trikes with an engine capacity not less than 261 ml and not exceeding 660 ml

Notice of Invitation of Applications for an Exploration Licence
I, BARRY ALAN GOLDSTEIN, Director Petroleum and Geothermal, Minerals and Energy Resources, Department of Primary Industries and Resources in the State of South Australia, pursuant to the provisions of the Petroleum Act 2000 and pursuant to delegated powers dated 28 March 2002, Gazetted 11 April 2002, page 1573 and in accordance with section 22 (1) of the Petroleum Act 2000, on behalf of the Minister for Mineral Resources Development (Minister) hereby invite applications for the grant of an Exploration Licence in respect of the available/to be available areas within the described areas below and shown on the attached plans.
The attached plans define the available areas within Areas CO 2009-A, B, C, D and E within respective Zones A, B, C, D and E. If additional areas (e.g. further relinquished production or exploration licence areas) become available before 17 September 2009 (i.e. 28 days before the closing date for bidding) they will be added to the available areas—refer to notification on www.pir.sa.gov.au/petroleum on or after 17 September 2009, for full details of available areas for each bid block. The current minimum available areas of the bid blocks and plans and descriptions of each Zone are as follows:

Special Conditions
Licence Term
The PELs will be offered for a five-year term with a right of renewal for a further five-year term at the end of the initial term, with compulsory relinquishment of 50% of original area at renewal. If proposed amendments to the Petroleum Act 2000, are enacted in the interim (before grant), they will be granted for an initial five-year term with a right to a further two five-year terms with a minimum relinquishment of 33.33% of original area at each renewal (subject to prevailing Petroleum Act 2000 provisions).
Security
A minimum $50 000 security (amount subject to review) will be required to be lodged by the licensee prior to entering the guaranteed licence term in which seismic or well activities are planned.
Applications
Applications lodged under section 65 (1) of the Petroleum Act 2000, are required to be made in the approved form as identified on the DVD ‘Cooper Basin Acreage Release CO 2009-A, B, C, D and E’ (can be ordered from: www.petroleum.pir.sa.gov.au or the Director Petroleum and Geothermal at the address below).
Applications:
• must satisfy the requirements of Regulation 4 of the Regulations under the Petroleum Act 2000;
• must be accompanied by a proposed work program for the first five year term of the licence;
• must be accompanied by a statement of the financial and technical resources available to the applicant; and
• must be accompanied by the scheduled application fee.
Applications close at 4 p.m. on Thursday, 15 October 2009 (Australian Central Time).
The following special instructions for lodgement of applications should be observed:
• the application and supporting data, together with the scheduled application fee (currently $3 328 per PEL application, but expected to increase on 1 July 2009), payable to the Department of Primary Industries and Resources SA, should be sealed in a plain envelope or package and clearly marked as ‘Application for Area CO 2009-A, B, C, D or E—Commercial-in-Confidence’;
• the envelope or package should then be enclosed in another envelope and posted, or delivered by hand to:

Criteria for Assessment of Applications
The winning bidder will be selected on the basis of the five year work program bid. The work program must include a statement of exploratory operations the applicant proposes to carry out in each year of the first five-year licence term. The aim of the work program is to evaluate the prospectivity of the licence area and discover regulated resources. It is expected that at least one petroleum exploration well would be included in the five-year work program.
Bids will be assessed taking account of the criteria listed below. It is important to note that the timing of well drilling and seismic acquisition will be taken into account. The most important criteria for assessment of CO 2009-A, B, C, D or E work programs are:
• the number of exploration wells to be drilled in the licence area (development wells are not considered);
• the number of years the applicant is prepared to guarantee the program;
• the extent to which proposed wells are supported by seismic data;
• the amount and nature of seismic surveying to be carried out and its timing;
• other data acquisition (e.g. gravity, aeromagnetic or geochemical surveys);
• seismic reprocessing to be carried out;
• adequacy of financial resources and technical expertise available to the applicant; and
• the applicant’s past performance in fulfilling work program commitments elsewhere in Australia.
The Minister will announce the winning bidder, together with details of the work program.

PURSUANT to section 44 of the Radiation Protection and Control Act 1982, I, Keith Baldry, Director of the Radiation Protection Division of the Environment Protection Authority, being a person to whom the powers of the Minister under that section have been delegated under the Act, exempt persons who dispose of domestic ionisation chamber smoke alarms into domestic waste from the requirements of Regulation 133 of the Radiation Protection and Control (Ionising Radiation) Regulations 2000, subject to the following conditions:
(1) A person must not dispose of a smoke alarm that contains more than 40 kilobecquerels of americium-241.
(2) A person must not dispose of more than two domestic smoke alarms into domestic waste during any period of seven days.
(3) The exemption shall take effect commencing on the date of publication of this Notice in the Government Gazette.

NOTICE OF CONFIRMATION OF ROAD

Road Closure, Western River
BY Road Process Order made on 30 October 2008, the Kangaroo Island Council ordered that:
1. Portion of the un-named public road situate north of Western River Road and between Section 16, Hundred of Gosse and allotment 23 in Deposited Plan 50567, more particularly being the greater portion of the land lettered ‘A’ on Preliminary Plan No. 08/0051 be closed.
2. Issue a Certificate of Title to the Kangaroo Island Council for the whole of the land subject to closure which land is being retained by the Council for public purposes.
On 12 December 2008 that order was confirmed by the Minister for Infrastructure conditionally upon the deposit by the Registrar-General of Deposited Plan 79677 being the authority for the new boundaries.

BY Road Process Order made on 24 September 2007, The District Council of Tumby Bay ordered that:
1. Portion of Mottled Cove Road adjoining section 181, Hundred of Dixson, more particularly delineated and lettered ‘A’ in Preliminary Plan No. 04/0016 be closed.
2. The whole of the land subject to closure be transferred to David Ian MacDonald and Josepha Paula MacDonald in accordance with agreement for transfer dated 24 September 2007 entered into between The District Council of Tumby Bay and D. I. and J. P. MacDonald.
