Approval of Category B Containers

I, ANDREA KAYE WOODS, Team Leader, Container Deposit Legislation and Delegate of the Environment Protection Authority (‘the Authority’), pursuant to section 68 of the Environment Protection Act 1993 (SA) (‘the Act’) hereby:



Approval of Category B Containers

Approve as Category B Containers, subject to the conditions in subclauses (1), (2), (3) and (4) below, each of the classes of containers identified by reference to the following matters described in the first 4 columns of Schedule 1 of this Notice which are sold in South Australia:



(a) the product which each class of containers shall contain;

(b) the size of the containers;

(c) the type of containers; and

(d) the name of the holders of these approvals.

(1) That containers of the class to which the approval relates must bear the refund marking specified by the Authority for containers of that class.

(2) The holder of the approval must have in place an effective and appropriate waste management arrangement in relation to containers of that class. For the purpose of this approval notice the company named in Column 5 of Schedule 1 of this Notice is the nominated super collector.

(3) In the case of an approval in relation to Category B containers that the waste management arrangement must require the holder of the approval to provide specified super collectors with a declaration in the form determined by the Authority in relation to each sale of such containers by the holder of the approval as soon as practicable after the sale.

(4) The holder of these approvals must ensure that if a sticker bearing the refund marking has been approved, and is applied to the container, then the sticker must not be placed on any portion of the opening mechanism or in any other place that would require complete or partial removal of the sticker before the contents may be consumed.

FISHERIES MANAGEMENT ACT 2007: SECTION 115

TAKE notice that pursuant to section 115 of the Fisheries Management Act 2007, Fromager Pty Ltd, holder of Spencer Gulf Prawn Fishery Licence No. P12 issued pursuant to the Fisheries Management (Prawn Fisheries) Regulations 2006 (the ‘exemption holder’), or a master registered on the licence, are exempt from the notices made under section 79 of the Fisheries Management Act 2007, prohibiting the taking of western king prawns (Melicertus latisulcatus) but only insofar as the exemption holder shall not be guilty of an offence when using prawn trawl nets in accordance with the conditions of their fishery licence for the purpose of research activities, as directed by SARDI Aquatic Sciences (the ‘exempted activity’), subject to the conditions contained in Schedule 1, from 2030 hours on 9 February 2009 until 0630 hours on 10 February 2009.

Schedule 1

1. All trawling activity must be completed by 0630 hours with nets out of the water.

2. The exempted activity may only be conducted whilst using the boat, Miss Anita, that is registered on Spencer Gulf Prawn Fishery Licence No. P12.

3. The exemption holder must comply with instructions from the SARDI Scientist and work within the allotted research area determined by SARDI.

4. All fish, other than those required for research purposes taken during the exempted activity, are to be returned to the water immediately after capture.

5. All fish, prawns, southern calamary and slipper lobster taken pursuant to the exempted activity must not be retained by the exemption holder, his agent or crew.

6. While engaged in the exempted activity, the exemption holder must have on board his boat or near his person a copy of this notice. Such notice must be produced to a PIRSA Fisheries Compliance Officer if requested.

7. The exemption holder must not contravene or fail to comply with the Fisheries Management Act 2007, or any other regulations made under that Act except where specifically exempted by this notice.

FISHERIES MANAGEMENT ACT 2007: SECTION 115

TAKE notice that pursuant to section 115 of the Fisheries Management Act 2007, Leon Charles Wright (the ‘exemption holder’), the holder of Marine Scalefish Fishery Licence No. M522, is exempted from section 70 of the Fisheries Management Act 2007, but only insofar as the exemption holder may collect sea mullet (Mugil cephalus) using a haul net for exploratory fishing purposes (the ‘exempted activity’), subject to the conditions specified in Schedule 1, from 14 February 2009 until 30 June 2009, in the five regions specified in Schedule 2, unless this notice is varied or revoked earlier.

Schedule 1

1. The exemption holder may only take sea mullet (Mugil cephalus) pursuant to this exemption, all other species must be returned to the water immediately.

2. The exemption holder may not undertake any other fishing activities whilst undertaking the exempted activity.

3. The exempted activity may only be undertaken using a boat registered on Marine Scalefish Fishery Licence No. M522.

4. Only a haul net with minimum mesh size of 7.62 cm may be used pursuant to this exemption.

5. The exempted activity may only be undertaken in depths of 3 m or less.

6. The exempted activity can only be undertaken between 0600 hours and 2000 hours on any given day.

7. A maximum of 9.5 tonnes of sea mullet (Mugil cephalus) may be taken pursuant to this exemption.

8. All fish must be accurately weighed and consigned to the registered fish processor The Fish Factory Pty Ltd, Fish Processor Registration No. FP0018, within 12 hours of being landed.

9. Within 24 hours of consigning the catch to a registered fish processor, the exemption holder must provide PIRSA Fisheries with copies of receipts indicating the total landed weight. These are to be faxed to PIRSA Fisheries on 8226 0434 (Policy) and 8449 1646 (Compliance).

10. Information about fish collected pursuant to this exemption must be recorded in the Marine Scalefish Daily Fishing Log sheets that are completed in accordance with the Fisheries Management (Marine Scalefish Fisheries) Regulations 2006. This information may be recorded on the same log sheet as information supplied for normal fishing activities for that day. Each log sheet is to be provided to SARDI in accordance with the regulations.

11. The exemption holder must notify PIRSA Fisheries on 1800 065 522 at least four hours prior to conducting the exempted activity and answer a series of questions about the exempted activity. The exemption holder will need to have a copy of the exemption notice at the time of making the call, and be able to provide information about the area and time of the exempted activity, the vessels and vehicles involved and other related questions. Exemption No. 9902216.

12. The exemption holder must allow a PIRSA Fisheries Compliance Officer or another nominated person to be present on board the boat during the exempted activity if requested by PIRSA Fisheries.

13. While engaged in the exempted activity, the exemption holder must have in his possession a copy of this notice and produce a copy of this notice if requested by a PIRSA Fisheries Compliance Officer.

14. The exemption holder must not contravene or fail to comply with the Fisheries Management Act 2007, or any regulation made under that Act, except where specifically exempted by this notice.

TAKE notice that, pursuant to section 32 of the Land and Business (Sale and Conveyancing) Act 1994 (‘the Act’), I, Gail Gago, Minister Consumer Affairs, do hereby exempt UPL (SA) Pty Ltd from the application of:

Closure of Bool Lagoon Game Reserve and Hacks Lagoon Conservation Park on days of Total Fire Ban

PURSUANT to Regulations 8 (3) (b) and 8 (3) (d) of the National Parks and Wildlife (National Parks) Regulations 2001, I, Edward Gregory Leaman, Director of National Parks and Wildlife, close to the public, the whole of Bool Lagoon Game Reserve and the whole of Hacks Lagoon Conservation Park whenever a Total Fire Ban is in force in the Lower South East Fire Ban District, as declared by the South Australian Country Fire Service (CFS) during the 2008-2009 Fire Danger Season.

The purpose of the closure of the reserves is in the interests of public safety.

THE Australian Energy Market Commission (AEMC) gives notice under the National Electricity Law of the following matter.

Under section 107A, the period of time for the making of the final determination on the Transmission Network Prices Publication Date Rule proposal (Project No. ERC0069) has been extended to 26 March 2009. The AEMC requires further submissions on whether to permit transmission network service providers to use the draft maximum allowed revenue (MAR) for transmission price setting if the final MAR is not available in time. Submissions must be received by 6 March 2009.

Submissions on this proposal can be forwarded to submissions@aemc.gov.au and must cite the Project No. in its title.

Submissions should be submitted in accordance with the AEMC’s Guidelines for making written submissions on Rule change proposals. The AEMC publishes all submissions on its website subject to a claim of confidentiality.
